Terms of Service

Effective date: July 18, 2026

1. Purpose

These Terms govern the rights, obligations, and responsibilities between loonshotstudio ("Company") and members regarding the use of the PromoAI service ("Service").

2. Definitions

  • "Service" means the AI-based image analysis and promotional content (text/image) generation service provided by the Company.
  • "Member" means a person who agrees to these Terms, creates an account, and uses the Service.
  • "Plan" (subscription pass) means a paid product granting expanded features/usage for a set period.

3. Effect and Amendment of Terms

  • These Terms take effect when posted within the Service.
  • The Company may amend these Terms within the limits of applicable law, giving prior notice of the effective date and reason.
  • For amendments unfavorable to members, notice is given at least 7 days (30 days for material changes) before the effective date.

4. Description of the Service

  • The Company provides image analysis and promotional content generation using third-party AI services (OpenAI, Google Gemini, Anthropic Claude, etc.).
  • AI-generated results are for reference only. The Company does not warrant their accuracy, legality, or fitness for commercial use. Final use and responsibility rest with the member.
  • Usage limits and available features may differ between free members and paid plan members.

5. Registration and Account

  • Registration is completed by agreeing to these Terms and following the Company's procedure, including email verification.
  • Members are responsible for keeping account information accurate; the Company is not liable for damages arising from a member's failure to manage their account.
  • Members may delete their account at any time from the profile page.

6. Paid Plans and Payment

  • A plan is a one-time purchase valid for 30 days from payment. It does not auto-renew or recur. To continue after expiry, you must purchase again.
  • If you purchase again while a plan is still valid, the new period is added (carried over) to the remaining days.
  • Prices and inclusions follow what is shown on the in-service checkout screen; displayed prices may include VAT.
  • Payments are processed through the payment processor (Erumpay), which handles payment credentials.

7. Withdrawal and Refunds

  • A plan is digital content that becomes usable immediately upon payment.
  • If you have not used the Service at all after payment, you may request a full refund within 7 days of payment.
  • Even after use has begun, the Company refunds the remaining period on a pro-rata basis for consumer protection. In this case, the amount corresponding to the period already used and actual costs such as payment processing fees may be deducted.
  • If the Service could not be used normally due to reasons attributable to the Company (e.g., outages), the Company will extend the period, or refund an amount corresponding to the outage, in proportion to the extent and duration of the disruption.
  • Refunds are issued to the original payment method and may take several business days per the processor's policy.

8. Member Obligations and Prohibited Conduct

  • Impersonating others or registering false information
  • Generating or distributing content that violates law or public morals, or infringes third-party rights (copyright, trademark, likeness, etc.)
  • Abnormal automated access, causing excessive load, reverse engineering, or otherwise disrupting the Service
  • Transferring, lending, or selling a plan or account to others

9. Changes and Suspension of the Service

  • The Company may change or suspend all or part of the Service for operational/technical reasons, with prior notice.
  • The Company is not liable for suspensions caused by force majeure, including outages of third-party AI or payment services.

10. Limitation of Liability

  • Unless otherwise required by law, the Company is not liable in connection with the use of the Service provided free of charge.
  • Members are responsible for consequences arising from their use of AI-generated results.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Korea, and disputes are subject to the competent court under the Korean Civil Procedure Act.
